1. Provider and scope
These Terms and Conditions apply to contracts with Ahmad Wali Achakzai, trading as ProDolmetscher.de, Bonner Str. 46, 53424 Remagen. Deviating terms of the client apply only if expressly accepted by us.
2. Request and conclusion of contract
Submitting a request, upload or contact form does not in itself constitute acceptance of a paid assignment. A contract is concluded when a specific offer is accepted, an assignment is expressly confirmed by us or performance begins on the basis of a clear individual agreement. Mandatory statutory information and withdrawal rights of consumers remain unaffected.
3. Scope of services
The type, language direction, scope, format, deadline, certification and other requirements are determined by the relevant offer or order confirmation. Additional services not expressly agreed are not automatically owed.
4. Client cooperation
The client must provide all documents required for the service in full, legible form and in good time and must indicate special spellings, technical terms, intended purposes, deadlines and formal requirements. Changes or additions after the assignment has been placed may affect price and delivery date.
5. Translations
Translations are prepared according to the agreed purpose and the source documents provided. Illegible, ambiguous or evidently incorrect passages may be marked or handled after clarification. Recognition by a particular authority, court, university or other body is only owed where expressly agreed and legally capable of being guaranteed.
6. Interpreting services
For interpreting services, the date, location or communication channel, languages, expected duration and special requirements must be agreed in advance. Waiting times, significant overruns, travel time or short-notice changes may be charged where agreed in the offer or order confirmation.
7. Prices and payment
The prices stated in the offer or order confirmation apply. The invoice issued is authoritative, taking applicable tax rules into account. Invoices are due without deduction within the stated payment period.
8. Delivery dates
Delivery dates and deadlines are binding only if expressly confirmed as binding. Delays caused by missing documents, subsequent changes or circumstances outside our reasonable control may result in an appropriate adjustment of the deadline.
9. Review and complaints
Please review the service after receipt and report any apparent complaints as soon as reasonably possible. Statutory warranty rights, especially those of consumers, are not restricted. Justified errors will be corrected in accordance with statutory rights or the agreement made.
10. Confidentiality and documents
Documents and information are treated confidentially and used only as required for processing, quality assurance, billing and legal obligations. Where suitable translators, interpreters or technical service providers are involved, information is disclosed only to the extent necessary.
11. Liability
We are liable in accordance with statutory provisions for intent, gross negligence and mandatory statutory liability cases. In the event of a slightly negligent breach of essential contractual obligations, liability is limited, where legally permissible, to the typical foreseeable loss. Mandatory consumer rights remain unaffected.
12. Consumers and withdrawal
Consumers may have a statutory right of withdrawal for distance contracts. Details are provided in the Withdrawal information. If, at the consumer’s express request, a service is to begin before the withdrawal period expires, the statutory conditions concerning compensation for services provided and possible expiry of the right of withdrawal apply.
13. Final provisions
German law applies, subject to mandatory consumer protection rules. For businesses, legal entities under public law or special funds under public law, a place of jurisdiction at the provider’s registered office may be agreed where legally permissible and effectively agreed. If individual provisions are invalid, statutory rules and the remaining valid provisions remain unaffected.
14. Consumer dispute resolution
We are not obliged and are currently not willing to participate in dispute resolution proceedings before a consumer arbitration board.
